Terms & Conditions
The owner and operator of this site is Sikh Virasat, (15 Sun Pac Blvd Brampton, Unit#26, L6S 0E8 and 328 Passmore Avenue Scarborough, Unit#15, M1V 5J5 Canada). By purchasing products from “Sikh Virasat” through this website the purchaser (“Customer”), agrees to the following terms and conditions of sale.
1. Ordering
1.1 When the Customer confirms its purchase order, the Customer agrees to purchase the products in the Customer’s “shopping cart” for their price and shipping and handling charges extra as applicable.
1.2 Sikh Virasat will send the products to the Customer as soon as practicable after it receives payment for the products.
2. Defective products
2.1 If the Customer gets a defective product from Sikh Virasat, the Customer must return the product to Sikh Virasat within 14 days of receiving the product, with a copy of the invoice for the product and a brief letter which includes the Customer’s details and identifies the defect in the product.
2.2 If the product is defective, Sikh Virasat will in its discretion, either:
(a) replace the product; or
(b) provide a refund of the price of the defective product to the Customer except fragile items as mentioned with the product.
2.3 Sikh Virasat will not accept any liability for any defective product which the Customer does not return in accordance with clause 2.1
2.4 In no case shall the maximum liability of Sikh Virasat exceed the price of the product in respect of which a claim is made.
3. Stock availability
3.1 The Customer shall not be entitled to object if details about products on the Website are not correct or if advertised products are not available or if images of products differ from the actual products.
3.2 If the Customer pays for a product which Sikh Virasat cannot supply Sikh Virasat will refund the price of that product to the Customer.
3.3 Prices, offers and stock availability may vary between sikhvirasat.ca and Sikh Virasat stores.
4. Products sent to an incorrect address
4.1 If the Customer does not receive the products within 30 days of the date of purchase, it must be notified. Sikh Virasat shall not be liable to the Customer for those products unless the Customer notifies Sikh Virasat within 30 days of the date of purchase.
4.2 If a product is not received by a Customer because it was sent by Sikh Virasat to an incorrect address due to an error by Sikh Virasat then Sikh Virasat shall be responsible for the resending or sending in replacement of the product or refunding of the price of the product.
4.3 If a product is not received by the Customer because the Customer provided an incorrect or insufficient address, then:
(a) subject to clause, if the product is returned to Sikh Virasat, Sikh Virasat will resend the product to the Customer provided that the Customer firstpays the cost of postage and handling for resending; or
(b) if the product is not returned to Sikh Virasat, then Sikh Virasat shall have no further responsibility.
5. Non-claimed products
If products which a Customer has purchased are returned to Sikh Virasat by a person other than the Customer and Sikh Virasat cannot, despite reasonable efforts, contact the Customer or the Customer does not contact Sikh Virasat within 1 month of products received by Sikh Virasat then no claim shall be entertained afterward.
6. Delays
The Customer agrees not to hold Sikh Virasat liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
7. Passing of risk and ownership
7.1 Subject to clauses and Sikh Virasat does not accept any liability for products after it has sent the products to the Customer.
7.2 The ownership of products purchased by the Customer shall pass to the Customer upon Sikh Virasat sending the products to the Customer.
8. Limitation of liability
8.1 Sikh Virasat shall not be liable to the Customer for refunding the price of products or replacing or exchanging products which the Customer purchases through Sikh Virasat’ website.
8.2 Sikh Virasat shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services which the Customer purchases through Sikh Virasat’ website, even if Sikh Virasat has been advised of the possibility of such damages.
9. Site access
9.1 Sikh Virasat hereby grants the Customer permission to access, view and download the content appearing on this site, for personal, non-commercial use only.
9.2 The Customer agrees not to use any device, method or software to interfere with the proper the functioning of this site including but not limited to: spiders, robots, avatars, agents, data mining, gathering or extraction tools and attempts to probe, scan, or test or breach security and authentication measures.
10. Intellectual property
10.1 The Customer agrees that the content which the Customer accesses, views or downloads and the software used to create it remains the intellectual property of Sikh Virasat.
10.2 The Customer agrees not to modify or alter the content of the website in any way, or make it available to any third parties.
11. Communications
By creating an account with Sikh Virasat the Customer consents to receive electronic communications from Sikh Virasat. The Customer’s personal details will not be sold or leased to any third party. For more information please see our Privacy Policy.
12. Typographical Errors
In the event, a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Sikhvirasat.ca shall have the right to refuse or cancel any order placed for product listed at the incorrect price. Sikhvirasat.ca shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Sikhvirasat.ca shall immediately issue a credit of the amount charged to your account.
13. Reviews and Comments
Except as otherwise provided elsewhere in this Agreement or on the Site, anything that you submit or post to the Site and/or provide to Sikh Virasat including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively, "Submissions") is and will be treated as nonconfidential and nonproprietary and Sikh Virasat shall have the royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such Submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble or decompile such Submissions. All Submissions shall automatically become the sole and exclusive property of Sikh Virasat and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant Sikh Virasat the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, comment, or other content. You represent and warrant that you own or otherwise control all of the rights to the reviews, comments and other Content that you post on this Site and that use of your reviews, comments, or other Content by Sikh Virasat will not infringe upon or violate the rights of any third party. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead Sikh Virasat or third-parties as to the origin of any Submissions or Content. Sikh Virasat may, but shall not be obligated to, remove or edit any Submissions (including comments or reviews).
14. Termination and effect of Termination:
In addition to any other legal or equitable remedies, Sikhvirasat.ca may, without prior notice to you, immediately terminate the Agreement or revoke any or all of your rights granted under this Agreement. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and Sikhvirasat.ca shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this Agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.
15. International Access:
This Site is a global site and all the relevant local laws and regulations would be applicable and need to be complied by the user of the website
16. Governing law and jurisdiction
These terms and conditions are governed by, take effect and will be construed in accordance with the laws of Ontario, Canada and the Customer irrevocably and unconditionally agrees to submit to the exclusive jurisdiction of the courts in Ontario Court of Justice entitled to hear appeals therefrom.
17. Information about Products.
We have taken all care to provide the information about products in a balanced and objective way, but we shall not be liable for any claim whatsoever for any discrepancy or incorrect information. Similarly, we have tried our best to provide information about the author(s) based on known and reliable sources, but we shall not be liable for any claim for any incorrect information. However, any suggestion from any quarter to correct the information will be entertained by us subject to the scrutiny of our editorial board.
